Travel & Holidays
UK air passenger rights remain in place post-Brexit under UK261/2004. If your flight was delayed, cancelled, or you were denied boarding — or your package holiday was significantly different from what was advertised — you're entitled to compensation.
Types of dispute this covers
Flight delays and cancellations
Compensation under UK261/2004: £220 (under 1,500km), £350 (1,500–3,500km), £520 (over 3,500km) if delay exceeds 3 hours and was not caused by extraordinary circumstances.
Package holidays
Under the Package Travel Regulations 2018, a significantly different holiday entitles you to a price reduction or full refund. If the company fails to deliver, full refund within 14 days is required.
Hotel / accommodation
Rights under the Consumer Rights Act 2015. The service must match its description. Fight My Corner generates the letter to the hotel or booking platform.
The law that applies
UK Retained Regulation (EC) No 261/2004 (UK261)
Air passenger compensation rights: fixed amounts for delay, cancellation, or denied boarding. Not extraordinary circumstances = compensation due.
Package Travel and Linked Travel Arrangements Regulations 2018
Full refund if package is cancelled. Price reduction or refund for significant changes. Organiser must reimburse within 14 days.
Consumer Rights Act 2015
Services must match their description and be performed with reasonable care and skill.
The process — step by step
Formal claim letter to the airline or travel company
Assert your right to compensation or refund under the relevant regulation. Set a 14-day deadline.
ADR scheme escalation
Airlines must belong to an approved ADR scheme. Escalate if unresolved: AviationADR, CEDR, or (for regulated issues) the CAA.
Escalation path
AviationADR / CEDR / Civil Aviation Authority (CAA)
Airlines are required to offer ADR. Schemes are free to consumers. The CAA can take action against airlines that repeatedly fail to honour passenger rights.
Important warnings
Extraordinary circumstances (severe weather, air traffic control strikes, security incidents) exempt airlines from compensation — but not from duty of care obligations.
Package holiday refund deadlines are legally binding — 14 days from cancellation.
'Vouchers' offered in place of refunds are not mandatory — you are legally entitled to cash refunds under UK261 and the Package Travel Regulations.
